These terms describe the rules that govern your use of Analese. They're written for customers in plain language, but they don't substitute for legal advice — please consult a lawyer if you need specific guidance about your situation.

Who we are & what these terms cover
Analese is the self-serve AI receptionist + in-app CRM for service businesses — answer every call, book calendar slots, capture every lead, and track every pipeline deal without an agency. These terms describe the rules that govern your use of Analese's website, dashboard, and AI receptionist service (together, the "Service").
By signing up, signing in, or otherwise using the Service, you agree to these terms. If you do not agree, do not use the Service.

The service
Analese provides an AI receptionist that answers inbound calls, books appointments on your connected calendar, captures leads into an in-app CRM, and surfaces transcripts, recordings, and pipeline status in the dashboard. The product is self-serve — there is no agency in the middle and no kickoff call is required.
You connect the Service to a phone number, a calendar, and (optionally) a CRM. The Service operates against those connections on the rules you configure inside the dashboard.

Your account
You must provide accurate business information when you sign up and keep it current. You are responsible for safeguarding your login credentials and for every action taken under your account, including by staff seats you provision.
You agree to notify us promptly of any unauthorized use of your account. We are not responsible for losses caused by unauthorized account use that you could reasonably have prevented by safeguarding credentials or revoking a staff seat.

Subscriptions & billing
Plan pricing, recurring billing cadence (monthly or annual), and the features included on each tier are stated on the live pricing page at /pricing and confirmed in the checkout flow. You can upgrade, downgrade, or cancel from the dashboard at any time.
Recurring charges continue until you cancel. Refunds are governed by what is stated at checkout and on the pricing page at the moment of purchase; if neither promises a refund window, fees are non-refundable except as required by law. Past-due balances may suspend the Service until paid.

Acceptable use
You agree not to use the Service for any illegal purpose, to harass or harm callers, to send spam, to impersonate any person or entity, to reverse-engineer or attempt to derive the AI model or its prompts, or to use the Service in any way that would cause us to lose the right to offer it.
You also agree not to upload content you do not have the right to use, not to use the Service to record calls in violation of any consent law that applies in your jurisdiction, and not to interfere with other customers' use of the Service.

Your responsibilities
You own the content you upload — business information, call recordings you bring in, call scripts, after-hours greetings. You must have the rights to that content and the lawful basis to record and handle calls per your jurisdiction's consent rules (one-party or two-party, as applicable).
You are responsible for what the AI says on your behalf. Review the AI's configured behavior, monitor transcripts, and confirm that the greetings, disclosures, and booking rules it operates under match what your callers expect and what your jurisdiction requires.

Service limitations
We aim for best-efforts uptime, but the Service is provided on an "as available" basis and we do not guarantee that any specific call will be answered, that any specific outcome will be achieved, or that the AI will never misunderstand a caller.
"Answer every call" is a product aspiration, not a guarantee. You are responsible for verifying bookings that matter — appointments that carry legal, medical, or financial weight should be reconfirmed with the caller through your normal channels.

Intellectual property
Analese owns the Service — the brand, the AI integration, the dashboard code, the operator console, and the documentation. We retain all right, title, and interest in those assets and license the Service to you, not sell it.
You retain ownership of your business content (business info, recordings you bring in, scripts, after-hours greetings). You grant us a limited, revocable-on-termination license to process that content for the sole purpose of operating the Service for you.

Privacy-related boundaries
Caller data — audio, transcripts, contact details — is handled per the practices described on /privacy, with operational safeguards described on /security: encrypted in transit and at rest, limited to the credential scope you granted at signup, and downloadable from the dashboard on your retention cadence.
The /privacy page describes personal-data handling, SMS disclosure and opt-out behavior, retention limits currently defined by the product, and request paths. The /security page covers operational safeguards. Neither page is an independent compliance certification; when pages conflict on data-handling detail, the security page controls for that detail and these terms control for the rest.

SMS program and consent
Analese customer-facing SMS uses a keyword-only consent flow. The initial invitation is: “Thanks for contacting Analese. You're messaging our AI assistant. By replying, you consent to receive AI-generated responses and to have your messages used for customer service and recordkeeping. Message and data rates may apply. Message frequency may vary. Reply STOP to opt out.” A recipient gives express written consent for further SMS only by replying with one clear opt-in keyword: YES, START, SUBSCRIBE, UNSTOP, Y, OK. A web form submission or arbitrary reply does not grant consent.
STOP-family keywords are STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, REVOKE and receive this exact confirmation: “You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.” HELP and INFO return: “Reply STOP to unsubscribe. Msg&Data Rates May Apply.” START is the keyword-only resubscription path; “RESUBSCRIBE” is not accepted. This shared gate applies to missed-call texts, appointment messages, waitlist openings, review requests, and receptionist replies. See /sms and /privacy for the full disclosure and privacy context.

Changes to these terms
We will update these terms as the product evolves. The updated version is posted on this page with a revised "Last updated" date. For material changes, we give you reasonable notice by in-product banner, an email to the address on your account, or both.
Continued use of the Service after the effective date of an update means you accept the updated terms. If you do not accept the updated terms, you may cancel from the dashboard before the effective date.

Termination & suspension
You may cancel your subscription from the dashboard at any time. Cancellation stops future charges; you retain access through the end of the period you have already paid for, and your data remains exportable from the dashboard during that period.
We may suspend or terminate your account for material breach — illegal use of the Service, non-payment, or abusive behavior toward our team or other customers. On termination, your data is exportable per the /security retention section; standard deletion runs thereafter.

Disclaimers, liability & governing law
The Service is provided "as is" and "as available," without warranties of any kind except those that cannot be excluded by law. To the extent permitted by law, our total liability for any claim arising out of or relating to the Service is capped at the fees you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, consequential, or punitive damages.
These terms are governed by the laws of the jurisdiction in which Analese is registered, without regard to conflict-of-laws principles; any dispute is handled in the courts of that jurisdiction. If any provision is held unenforceable, the remaining provisions stay in effect. These terms are the entire agreement between you and Analese regarding the Service, and they supersede any prior agreement on the same subject.
